pROS AND CONS OF MARTHA STEWART CASE
Here we discuss the pros and cons of ALL possible decisions/choices/outcomes relating to the discussion scenario:
Within the case with Martha Steward and Imclone systems there were many different decisions, choices and outcomes that were possible. Here we will take a look at many of the different decisions and choices everyone could of made during this case, the different outcomes in result of the different decisions and choices, and the Pros and Cons of all these different scenarios.
1) Martha Steward did in fact end up serving jail time.
Pros: This shows that no one is above the law and that you cannot break the law and get away with it.
Cons: Stocks in her own company dropped and her reputation and her company's reputation was damaged drastically by the large media coverage.
2) Every one that sold shares served time.
Pros: Everyone would of gotten the same punishment and would show that everyone is the same when they break the law.
Cons: The media only really covered Martha's case so the rest would of gone un-noticed by the public.
3) If the media did not cover it she might not of served time.
Pro: The reputation of her and her company would not of been damaged and she would not of lost money through the stocks of her company and her investors.
Cons: She would of gotten away with it and she might of been inclined to do this again.
4) She could of ignored the inside Information that she received.
Pros: She would of avoided doing anything illegal and would of avoided serving jail time and damaging her and her company's reputation.
Cons: She ( initially) would of lost a lot of personal money in those stocks.
5) She cold of been truthful and not lie and obstructed justice.
Pros: She might of avoided jail time because she was not indicted for the sale of stock based on insider trading but for obstruction of justice for lying to federal regulators under oath about the details surrounding the transaction. Plus this would of help her reputation somewhat by showing that she is in fact honest.
Cons: She could of faced punished for insider trading by admitting in taking part in it.
6) The broker could of acted lawfully.
Pros: He would of avoided jail time, fines, and could of helped others not break the law.
Cons: His customers would of been very unhappy and they could of decided to move on to a different broker, therefore having him lose his high end clients.
7) Dr. Sam Waksal could of not revealed information resulting in insider trading
Pros: He would not of done anything illegal and no one would of broken the law or faced jail time or of been punished in any way.
Cons: His family and friends would of lost a massive amount of money in the stocks ( initially) and they would not of been happy with him potentially.
